The decision by the Food and Drug Administration (FDA) of the US government that food comprised of gene-altered plant material will not be regulated differently from foods made of conventionally bred plants is discussed with reference to the trademarked Flavr Savr tomato developed by Calgene. The possibility of patent infringement by amateur gardeners growing the Flavr Savr tomato from seed is mentioned. The response of critics of the ruling is considered.
