This paper considers the case heard in January 1993 in which an Italian B-Section Tribunal (specialized agriculture), subsequently backed by the Court of Appeal, ruled that Farmer C and his son had to release some of the land and buildings leased by his now deceased father on the grounds that the terms of the lease do not give him rights to inherit it for farmer-managed enterprises.
