Technical innovation and intellectual property rights in agriculture

Italus Hortus 9(5): 35-45

This paper discusses the problem of intellectual property in agriculture for new plant cultivars and animal races (superior living organisms with self-reproduction capabilities), obtained through traditional or genetic engineering methods. In 1961, the UPOV Convention that establishes a sui generis protection known as "Plant Breeders' Rights" best suited to the plants was issued.
