Hanzel v. Arter

Hanzel v. Arter

Federal Suppl. 625: 1259-1266

Parents who contested a state statute requiring immunization of public school children did not have a valid constitutional claim or grounds for exemption from the statute for religious reasons. The basis of the parents' objection was their belief in "chiropractic ethics," a body of thought which holds that injection of foreign substances into the body is harmful. The U.S. District Court for the Southern District of Ohio found that mandatory immunization did not violate the constitutional right to privacy because bodily autonomy is not protected per se, nor were the parents' equal protection rights violated, because philosophical beliefs do not receive the same legal deference as religious beliefs.
