Matter of Chang [12 May 1989

The respondent sought asylum from the US government on the grounds that he faced persecution in China because of his opposition to that country's family planning policies and fear of being sterilized against his will. The Court rejected his application. It held that he had not established that he was persecuted or faced persecution on the grounds of race, religion, nationality, membership in a particular social group, or political opinion, as required by law. It ruled that the implementation of China's population policy did not constitute persecution under the law. It also rejected the argument that policy guidelines issued by the US Attorney General urging that careful consideration be given to applications of persons fearing to return to China because of its family planning policy supported the respondent's claim. It concluded that the guidelines do not apply to immigration judges and the Board of Immigration Appeals.
