The U.S. District Court for the District of Colorado ruled that the Secretary of Health and Human Services cannot prevent family planning clinics that receive funds under Title X of the Public Health Service Act from providing neutral information to women about abortions. The Court granted the family planning services' and physicians' motion for a preliminary injunction against federal regulations prohibiting counseling and referral for abortion services by Title X clinics on the grounds that the Secretary lacked the statutory authority to promulgate such regulations and that the proposed regulations violated a woman's Fifth Amendment right to choose whether to have an abortion, her First Amendment right to receive the medical information necessary to exercise her Fifth Amendment right, and the physician's First Amendment right to disseminate necessary medical information to patients.
